What mandatory clauses are included in Malaysian contracts?

Every employment contract issued by MalayHire complies with the Employment Act 1955 and includes the following mandatory or standard elements:
- Parties — MalayHire as employer and the employee's full legal name and IC/passport number
- Job title and duties — description of the role and primary responsibilities
- Commencement date — the date employment begins
- Gross salary — the agreed monthly remuneration
- Working hours — in compliance with the Employment Act (maximum 45 hours per week for employees covered by the Act)
- Annual leave entitlement — minimum as per the Employment Act based on years of service
- Sick leave entitlement — minimum as per the Employment Act
- Maternity leave — 98 consecutive days of paid leave for eligible female employees
- Notice period — minimum notice for termination by either party as set out in the Employment Act
- Probation terms — duration and performance review conditions
- Statutory contributions — reference to EPF, SOCSO, and EIS deductions
The contract is issued in English. Employees are entitled to request a Bahasa Malaysia version if required.
