What benefits are mandatory in Malaysia?

All employees employed through MalayHire are entitled to the following statutory benefits under the Employment Act 1955 and related Malaysian legislation:

  • Annual leave — 8 days (less than 2 years), 12 days (2–5 years), 16 days (5+ years)
  • Sick leave (without hospitalisation) — 14 days (less than 2 years), 18 days (2–5 years), 22 days (5+ years)
  • Hospitalisation leave — up to 60 days per year (inclusive of sick leave days)
  • Maternity leave — 98 consecutive days of fully paid leave for female employees; applies to up to 5 surviving children
  • Paternity leave — 7 consecutive days for male employees in the private sector (introduced under the Employment Amendment Act 2022)
  • Public holidays — minimum 11 gazetted public holidays per year
  • EPF contribution — employer contributes 12–13% of monthly salary
  • SOCSO coverage — work injury and invalidity protection
  • EIS coverage — employment insurance for retrenchment scenarios
