Can contracts be customized?

Yes, within the limits of Malaysian law. MalayHire's employment contracts are based on a compliant template that includes all mandatory clauses required under the Employment Act 1955. Within that framework, the following can be customized:

  • Job title and role description
  • Gross monthly salary and any fixed allowances
  • Probation period duration (up to a maximum that is reasonable under Malaysian practice)
  • Annual leave entitlement (can exceed the statutory minimum but not fall below it)
  • Notice period for resignation and termination (subject to Employment Act minimums)
  • Confidentiality and non-disclosure clauses
  • Additional contractual benefits (insurance, transport allowance, etc.)

Restrictive covenants (non-compete clauses) are generally unenforceable in Malaysia after employment ends, so MalayHire will advise against including terms that have no legal effect. Any customization requests outside standard parameters will be reviewed by MalayHire's team before the contract is issued.
